Progetto SCAN e European Small Claims Procedure
E' già online dalla fine di gennaio 2021, la Piattaforma European Small Claims, una web application capace di guidare il cittadino, step by step, ad utilizzare una speciale procedura europea per la risoluzione di controversie civili e commerciali transfrontaliere, di modesta entità in modo semplice, veloce ed a costi ridotti.
La Piattaforma è ospitata sul sito web del Progetto SCAN - Small Claims Analysis Net, cofinanziato dall'UE, in una sezione dedicata, in cui la procedura viene spiegata grazie alle tecniche di apprendimento cognitivo e legal design ed è il frutto della collaborazione internazionale del Consorzio SCAN che coinvolge altri 9 partner, del quale la Federico II è capofila, sotto la guida del responsabile scientifico Francesco Romeo (Ordinario di Logica ed Informatica Giuridica presso il Dipartimento di Giurisprudenza).
La piattaforma è capace di guidare, chi ne abbia necessità, a comprendere i presupposti di applicabilità della procedura Europea, quale sia la Corte Competente ed i costi della procedura.
La web application è stata sviluppata con software Ms Blazor su cloud Azure, per assicurare all'utente di potervi accedere da desktop o mobile in modo semplice. Si tratta di una versione beta (per ora solo in inglese) tuttavia pienamente operativa e progettata seguendo le regole del design thinking.
La sua struttura è basata sulla codifica dei regolamenti europei che disciplinano l'ESCP, in modo tale da risolvere in 3 step i punti principali di dubbio dell'utente: i tre step possono essere consequenziali o consultabili autonomamente dall'utente: Applicabilità (per stabilire se il proprio caso possa trovare soluzione con la procedura europea); Corte Competente e lingua (Tribunale che è competente a decidere sulla domanda e la lingua accettata in cui poter correttamente redigere il Claim Form ovvero Modulo di Domanda, vedi qui); Informazioni aggiuntive e Costi (per comprendere cosa fare se la Domanda è accolta o viene respinta, come farla eseguire, quali costi bisognerà affrontare per accedere alla procedura di risoluzione delle controversie transfrontaliere di modesta entità).
La procedura è rappresentata come se fosse un gioco (Il Gioco dell'ESCP), per questo tramite l'utente comprende, in modo intuitivo, la procedura ESCP prima di accedere alla Piattaforma vera e propria che lo guiderà nell'attivazione della domanda. Ciò rende la procedura user-friendly, facilmente agibile da chiunque anche privo di approfondite conoscenze giuridiche.
L'approccio human-centered rende la ESCP più vicina al cittadino, il quale può trovare risoluzione al danno o torto che ritiene possa aver subito, tanto da un acquisto quanto da un contratto non eseguito nei confronti di un altro cittadino dell'Unione Europea.
SCAN è uno strumento concreto, al servizio del cittadino per la rapidità ed efficienza della procedura Europea. Una giustizia sicura ed efficiente è un vantaggio soprattutto per i mercati svantaggiati, lontani dal centro economico, come nel caso della Campania e di tutto il Meridione. In questi casi la piattaforma può anche costituire un rafforzamento delle garanzie giuridiche per chi entra in rapporti economici con il Meridione, dando sicurezza nel rapporto economico.

SCAN - Small Claims Analysis Net: the first web application to easily use the European Small Claims Procedure.
Since 29 January, the European Small Claims Platform is online, a web application able to guide the citizen step by step to use a special European procedure for the resolution of cross-border small claims.
This is the ESCP procedure - European Small Claims Procedure introduced by Regulation no. 861/2007 (amended by Regulation no. 2421/2015), aimed at resolving, in a simple, fast and low-cost way, disputes involving citizens of EU countries (except UK and Denmark) and whose value does not exceed €5,000. This practice is still relatively unknown to legal practitioners and even less so to consumers or businesses.
The new webapp has been widely echoed in the specialised press and on the web (IlSole24Ore, Wired, Altalex). It is the result of the international collaboration of the SCAN Consortium (Univerza v Ljubjani – Slovenia; LUISS Libera Università Internazionale degli studi sociali Guido Carli – Italy; Vilniaus Universitetas – Lithuania; Vrije Universiteti Bruxelles – Belgium; Établissement d'Enseignement Superieur Consulaire Haute Études Commerciales de Paris (HEC) – France; Consiglio dell'Ordine degli Avvocati di Roma – Italy; Associazione italiani difesa consumatori ed ambiente (ADICONSUM) – Italy; Union des Avocats Européens (U.A.E.) – Luxemburg; University of Naples Federico II - Italy), of which the Federico II University is the leader, under the guidance of the scientific director Prof Francesco Romeo (Professor of Logic and Legal Informatics at the Department of Law). The Consortium has developed and presented a platform capable of guiding those who need it, to understand the prerequisites of applicability of the European procedure, which is the Competent Court and the costs of the procedure.
The web application was developed with Ms Blazor software on the Azure cloud, to ensure that the user can access it easily from desktop or mobile. It is a beta version (for the moment only in English) but fully operational and designed according to the rules of design thinking.
Its structure is based on the codification of the European regulations governing the ESCP, in such a way that the main points of doubt for the user are resolved in 3 steps: the three steps can be consequential or consulted independently by the user: Applicability (to determine whether your case can be resolved through the European procedure); Competent Court and Language (Court that is competent to decide on the application and the accepted language in which to properly draft the Claim Form, click here); Additional Information and Costs (to understand what to do if the Application is accepted or rejected, how to enforce it, what costs you will face to access the Small Claims Procedure).
The EuSCPlatform is hosted on the SCAN project website in a dedicated section where the procedure is explained using cognitive learning and legal design techniques.
The procedure is represented as if it were a game (The GAME of ESCP), so through this the user understands, in an intuitive way, the ESCP procedure before accessing the actual Platform that will guide him/her in activating the application. This makes the procedure user-friendly, easily accessible to anyone even without extensive legal knowledge.
The human-centred approach brings ESCP closer to the citizen, who can find a solution to the damage or wrong he/she feels he/she has suffered, be it from a purchase or an unfulfilled contract against another EU citizen.
SCAN is a concrete tool at the service of the citizen for the speed and efficiency of the European procedure. Safe and efficient justice is an advantage especially for disadvantaged markets, far from the economic centre, as in the case of Campania and the entire South. In these cases the platform can also constitute a strengthening of the legal guarantees for those who enter into economic relations with the South, giving security in the economic relationship.
